The latter. Seems like it's just the Bacup chairman's interpretation of FA rules and there's a lot of assumptions and extrapolation on his part. He also wants Bury FC to be allowed into the NL North for sentimental reasons it seems. I find it hard to trust him as a reliable source. If he is right the FA are a disgrace.

The NL would have to throw all their past decisions on financial regulations out of the water if they are to allow Bury FC back in.
They did let Gateshead go into NLN...

I think you are confusing NL for National League System.

They did let Gateshead go into NLN...

They were demoted from the NL though and the only reason they were allowed into the NLN was because they had new owners by that point.

Yeah, things changed after us, we were initially placed at the same level as Bury have been but put together a staggeringly good appeal to get us bumped up. They reviewed the whole process after that.

IIRC it was because the whole league system was being restructured in order to get leagues standardised, with equal numbers, so there were often vacancies at various levels & promotion/relegation wasn't quite so set in stone. Now that restructuring is largely complete, that's a thing of the past.

It's pretty pointless for Dale to keep up with getting Bury back in at NL level I imagine? I'm guessing most will move across to the new club, leaving him with a club with no-one turning up to games.

Why would Day get back involved at this point?

Why?
a: he is a vindictive bastard who loves nothing more than his villain status among the Bury fans.
b: he has been paid to keep the Ltd company alive so no investigation of the books can take place. ( He has history of moving servers in another company he "was trying to save", all the data on said servers was somehow lost!!!!!)

There is a very evident split in the fan base.
Phoenix club supporters are at a loss to see how anybody can still believe Dale has any good intentions and why some are still supportive (most aren't but are hopeful he will sell and the old club some hoe survive.
Old club still not come to terms with demise and are somehow clinging on to hope he sells a semi solvent club to A N Other.

Yes
We suspect he's after some potential sellons as well.
Most suspect he keeps the club "live" to thwart througher investigation of the accounts until he can hide the evidence

assuming that's the original Bury then that's a good decision - sorry for the fans - but i think most will follow the phoenix club anyway

There's a few on Twitter who have a right strop if they see it labelled a "phoenix" club, as they say the original club still exists... They're annoyed that the Bury AFC fans might lay claim to a couple of FA Cup wins 100-odd years ago.

Strange that football fans are loyal to a company with no staff or players that plays no football as opposed to an actual football club with footballers.

It's a tough one, our fans toyed with a phoenix idea as part of the boycott in preparation for us potentially going to the wall. Was a sad thought at the time and i'd no idea what i'd do, especially if technically the old club still existed.

That's the right attitude to have. I wish Bury the very best of luck climbing the leagues. Might even get myself a shirt haha
