Nowhere near an expert in this but is there an opposite to 'constructive dismissal' when the employee creates an environment by performing badly intentionally or where his/her actions/inaction cause their dismissal for financial gain from that immediate sacking?
In the normal world a sacking is preceded by the 'progressive steps' warnings process that could take weeks/months/years however...if it could be proved in a tribunal, especially if this is similar to his sacking at Gillingham, it might save us both some money?
You'd struggle to prove that in a tribunal as he isn't doing anything outrageous in terms of doing his job especially as Kelvin Thomas knew that is how he operated at Gillingham.
