I think it's pretty apparent that she wasn't capable of consenting to have sex with Clayton McDonald. She certainly says she wasn't able to consent (and to reiterate, I believe her). The CPS clearly agreed that it was likely. However, they were not able to prove beyond reasonable doubt to a jury.

I guess the jury were swayed by the fact that there was interaction between the two and that created sufficient doubt that Clayton McDonald believed she was capable of consenting to sex.

That doesn't mean "she was sober enough" or "she consented" or that Clayton McDonald was falsely accused; simply that there was sufficient doubt to acquit him in court where there wasn't (necessarily) for Ched Evans.

How inebriated was Clayton McDonald out of interest (that's to anybody not just IW specifically)? If he was intoxicated, even to a lesser extent, it too must have played into the court's decision ultimately as two drunk people meeting, flirting, and sleeping together is a lot less calculating and premeditated than showing up to a hotel, going through all this effort to get in and then exit whilst avoiding detection, which should really scream out to people why the cases were different.

It's been mentioned a few times in this thread that ''but what about the victim being harassed?'' as if that is somehow relevant to his innocence or guilt.

Someone shouldn't have their freedom based on whether on not unrelated 3rd parties have attempted to harass the victim. Jesus wept.

Finally, if someone can actually explain (there have been some attempts that have fallen short) how someone is meant to show remorse for a crime they maintain didn't happen and have been actively appealing against since the original verdict? Yes, alright, cheating on your missus isn't great, but that has nothing to do with it whatsoever.

Exactly, I have no idea why people struggle to get their heads round this.

Whether Evans believes he is innocent or not he should be remorseful for making the girl feel as if she had been taken advantage of and for putting himself in that situation to begin with.

I remember hearing parts of that website had to be redacted for legal reasons, but didn't know his family were behind harassing her. I imagine that's more a bunch of red-pill swallowing football morons above anything else, or they'd have surely been liable to end up in court?

As for the second part, again, how can he do that? If he comes out and says anything about it, it's harmful to him.

If he comes out and says ''I am really remorseful for being in that situation, and for making that girl feel like she's been taken advantage of'' then it reads like an admission. If he says ''I am sorry this girl, who had consensual sex with me, later regretted her actions'' then it predjudices things down the line. Anything to do with his family or girlfriend doesn't need any statement whatsoever.

Plus, not casting any light on if he is, or isn't, going to be found guilty, but if he is found innocent then he has spent two or three years wrongfully encarcerated. I doubt too many will be frothing at the mouth if there's no full remorseful apology from everyone then.

My point is, people shouldn't be getting caught up in whether or not he has or hasn't made a statement concerning remorse. He can't. Aside from a lot of the same old guff here, I can't get my head around the timing of this from Chesterfield.

By all means, have an agreement and do it behind closed door pending the trial, but announcing the signing of a player whose in court less than 2 months into the season just seems to be inviting a massive shitstorm for no real benefit.

So does that mean everyone should assume guilt from the off? No, of course it doesn't... our countries justice system does very ell on the basis of innocent until proven guilty. The assumption of innocence until proof of guilt doesn't damage the prosecution and doesn't determine rape cases, either Way :thumbs:

How can she not be sober enough to say yes to him and nothing to the next one? 20 mins or so was the time difference?

If you're on a night out, chatting to a girl and she agrees to go back to a hotel room with you, that is a pretty fucking clear indication of consent in my opinion, even if she is pissed.

Evans didn't get those signals, he doesn't have a leg to stand on I don't think.

Consent is consent, she could have been with him all night, chatting away telling him he's her soulmate, invited herself back but still say no. Equally, he can walk in on the centre half doing his thing, ask to join in and she says yes.

You'd seriously hope these cases are decided on more than signals.

I know a lad who was inside with Evans. Apparently there was a video of Ched sniffing coke with the girl, before she consensually started sex acts on the pair of them. The video was then deleted and was never seen before the courts. That is the new evidence that has come to light.

I also don't believe in this remorse rubbish. Surely showing remorse is a way of admitting you did the crime? Showing sympathy on the other hand.....

Even if he is found guilty hasn't he already served his sentence for the crime? He won't go back to jail now whatever happens so from Chesterfields point of view it's the PR that have to handle, not the fact he will be off to clink.

Definitely caused a massive split amognst our lot. Some think it is a good move SHOULD he get off in October. There are others who aren't happy, and a small number claiming they won't go whilst he is there. Can see all sides of the story.

FWIW i'm not suprised. Our board are complete and utter shitebags and some of what is going on at the club away from all of this is dispicable in my eyes. So doesn't suprise me we have done this without considering the fans thoughts.

Me - i'm on the fence. Could work out well for us. Ideal scenario is - he gets off in October, bags 20 goals for us, we go up/sell him for £1m. If he gets convicted in October then we will have a clause and off he will pop I imagine. Interesting if he scores 10 goals for us betwene now and October and then is found guilty..that would be a spanner in the works and question the morales of those on the board..

Why? The guy took a massive gamble as many players have with this group sex stuff and was the unlucky first to get a guilty verdict......something that had been coming.

He's just fortunate in these circumstances its harder to prove rape.

  • Evans’s fiancee, Massey, was accused in legal argument during the second trial of offering an “inducement” to a key witness. The prosecution said this had “the flavour of a bribe”. The trial judge disagreed with this description.
  • The appeal court judges, whose decision can be reported for the first time, expressed “a considerable degree of hesitation” before allowing in the new evidence of the former partners because it resulted in the complainant’s sexual behaviour being subject to forensic scrutiny – which is almost always banned.
  • The complainant continues to be named and abused on social media though the law gives her lifelong anonymity. The police are investigating one blog that identified her during the trial.
The woman told the jury she woke up naked in a hotel room in Rhyl, north Wales, in May 2011 with no memory of what had happened but fearing she had been attacked after her drinks were spiked.

The prosecution said she could not possibly have consented to sex as she was too intoxicated.

In court, Evans admitted he lied to get the key for the hotel room and did not speak to her before, during or after sex. He left via a fire exit. It also emerged that Evans’ younger brother and another man were trying to film what was happening from outside the room.

The only thing proven here is that the British justice system is an absolute joke. Something that comes as no real surprise to some of us.
